Terms Of Service
Below are my TOS that you must read and agree to prior to commissioning me.
What are TOS?
Terms Of Service (or TOS) are the legal agreements between a service provider and the person acquiring or using that service.
General Terms
By commissioning me you are stating that you have read and agree to all of my Terms Of Service.
You must be aged 18 years or older to commission me. No exceptions.
Payment
All commissions must be completely paid for before I will begin to work on your commission.
My only accepted payment methods are PayPal and Canadian E-interact.
All prices are listed in USD.
If you are paying via Paypal:
All payments sent through Paypal must be sent via “Friends and Family”.
Filing a chargeback will result in an immediate and permanent ban.
Filing a chargeback after I’ve sent you the completed artwork (that you commissioned from me) will result in you forfeiting ALL rights to that artwork.
Requesting or filing a claim to request a refund on your commission once you have already recieved is not permitted.
By filing a chargeback you will not have paid for the artwork and therefore the artwork is not yours. You will be prohibited to use, claim ownership over, share or post that artwork.
If you are caught doing so it will be considered Copyright Infringement and legal action will be taken against you.
Filing a chargeback may also result in you being added to my public blacklist, and I reserve the right to post a public warning/beware about you to caution other artists depending on the situation.
Refund and Cancellation Policy
I reserve the right to cancel and/or refund your commission at anytime for any reason.
You may cancel your commission and request a refund before I begin any work on your commission.
Once I have started to work on your commission I will not issue any refunds.
Any refunds will be issued strictly at my own discretion.
Filing a chargeback will result in you being banned from ever commissioning me again.
If you have received your commissioned artwork before filing the chargeback you will forfeit any and all rights to that artwork. That artwork will not belong to you. You will be prohibited from using, posting and sharing that artwork. If you are caught doing so it will be considered Copyright Infringement and legal action will be taken against you.
Filing a chargeback may also result in you being added to my public blacklist, and I reserve the right to post a public warning/beware about you to caution other artists depending on the situation.
Please do not commission me if you cannot afford to.
Chargebacks
Filing a chargeback will result in you forfeiting any and all rights and claim to the artwork you received from me.
As well as being banned from commissioning me again.
If you have received your commissioned artwork before filing the chargeback you will forfeit any and all rights to that artwork. That artwork will not belong to you. You will be prohibited from using, posting and sharing that artwork. If you are caught doing so it will be considered Copyright Infringement and legal action will be taken against you.
Filing a chargeback may also result in you being added to a public blacklist, and I reserve the right to post a public warning/beware about you to caution other artists, varying on the situation.
Process
When you commission me I will give you an estimated time of completion for your commission.
This amount of time will vary on numerous things, including but not limited to: my current queue, the complexity of your commission and my personal life (things such as falling I’ll or family emergencies etc. may cause delays.)
In some cases it may take me longer to complete your commission than I originally estimated. You will be notified immediately should this occur, and I will work with you to ensure you are satisfied with the new estimated time of completion.
Work In Progress images can be requested. All WIP images will be watermarked. Removing this watermark is prohibited.
Finished digital artwork will be e-mailed to you and sent to you via any other method you request (Please note that I will not make prints and mail them to you.)
Adoptables
You must pay for the Adoptable within 24 hours of claiming it.
Failure to pay within 24 hours may result in you being banned from buying Adoptables and commissioning me.
Once I receive payment, I will e-mail you the Adoptable artwork (with the watermark removed.)
You are permitted to use the Adoptable to create a Character/OC/Fursona/fursuit etc.
Each Adoptable is unique and I will not ever make duplicate copies of an Adoptable. You can however request that I make a similar version.
If you win an Adoptable auction you must pay within 24 hours. Failure to do so will result in you forfeiting the Adoptable and being banned from bidding in auctions and purchasing Adoptables in the future.
You must be aged 18 years or older to purchase adoptables from me. No exceptions.
Watermarks and Signatures
All of my artwork will have a small signature on it, unless specified. Signatures will be inconspicuous. You are not permitted to remove, edit or crop out the signature without explicit permission from me. Please respect this.
All of my WIP pictures will have a large watermark overtop of the artwork, you are not permitted to edit or remove the watermark in any way, shape or form.
Customer Satisfaction
I want all of my customers to be happy and very satisfied with their commission.
I will do my best to ensure that your experience with commissioning me is positive and that you are happy with the artwork I create for you.

Copyrights
I (Vitawny) hold all rights to all of the artwork that I create.
All artwork I create is Copyrighted and owned by me.
This means that I am permitted to use any and all artwork I have created to:
Promote myself, my work and my business on/in any website or location.
To publish it online or in a book.
To display it anywhere I wish.
To post online anywhere I want to.
Commercial Use
Purchasing Commercial rights to the artwork will cost a minimum of 300% of the original price for the commission. This is subject to vary based on each individual situation.
In some situations I may consult with a lawyer before selling Commercial use rights.
Please note that you will still be required to credit me for the artwork used commercially, even if altered or edited.
